The alarming surge of the second wave of Covid-19 in India has led the Supreme Court to order an extension of the period of limitation in all matters, including intellectual property matters, before all courts, tribunals, and authorities, until further orders. On March 8, 2021, the Supreme Court had lifted the earlier extension of limitation that had been in place since March 15, 2020, to take effect from March 14, 2021.
According to the order, the period from March 14, 2021 would be excluded from the computation of limitation periods under all general and special laws. The Supreme Court will revisit the extension of limitation next on July 19, 2021. Meanwhile, we will update you if the IP Office issues any notices in pursuance of this order.
