Update from India IP Office in view of extended COVID19 lockdown

On April 14, 2020, we informed about the nationwide lockdown in India being extended till May 3, 2020. The earlier lockdown was from March 25, 2020 to April 14, 2020.
 
Today, the Indian IP office (office of the Controller General of Patents Designs and Trademarks -CGPDTM), issued a [notification] in view of the extended lockdown. According to the notification:

  • The relaxation notified in the Public Notice of March 25, 2020 shall also be extended up to May 3, 2020. The March 25 notification stated that all deadlines and timelines prescribed under the IP Acts and Rules that fall due during the period of lockdown will automatically get extended to the date on which the offices re-open. Thus, all due dates falling within the fresh lockdown period are also automatically extended to May 4, 2020. 
  • All the hearings scheduled up to May 3, 2020 stand adjourned and fresh hearing dates will be notified thereafter.
  • The E-filing module of the IP office remains fully functional for all new filings/submission of documents in all proceedings. Accordingly, as much as possible, we suggest complying with all the due dates falling within this lockdown period.
