Shakespeare famously asked: “What’s in a name? That which we call a rose by any other name would smell as sweet”. The answer these days has a lot to do with where the name originates, because, to owners of geographical indications (GIs), names have everything to do with a product’s premium. This article will explore the existing framework for protection of GIs in India, some practical issues around the of GIs against the larger framework of TRIPS Agreement and the proposed new law on GIs passed by the Indian parliament.
